Terms of Service and End User License Agreement

1. Agreement to the Terms

By accessing or using the Service, creating an account, or completing a purchase, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority or the age required in your jurisdiction to consent to online services without parental permission, you may use the Service only with the involvement and permission of a parent or legal guardian as required by applicable law. By using the Service, you represent that you meet these requirements.

3. Description of the Service

Feynly helps you turn study materials into learning tools such as flashcards, quizzes, cloze exercises, mind maps, and related study aids, including AI-assisted features. Features may evolve over time. We do not guarantee that any particular feature will always be available or unchanged.

4. Accounts and Account Security

You agree to provide accurate registration information and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account. Notify us promptly at support@feynly.app if you suspect unauthorized access. You may delete your account as described in our Privacy Policy and on our account deletion page.

5. User Content

You retain ownership of content you submit to the Service (“User Content”). You grant Feynly a limited, worldwide, non-exclusive, royalty-free license to host, process, reproduce, transform, transmit, and display User Content solely as needed to provide, secure, maintain, and improve the Service in accordance with these Terms and the Privacy Policy. This license does not grant us rights to use your User Content for third-party advertising.

You represent that you have all rights necessary to submit User Content and to grant the license above, and that your User Content does not violate law or third-party rights.

If you provide feedback or suggestions about the Service, you grant Feynly a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation.

6. AI-Generated Content

Some features produce content automatically using third-party artificial-intelligence systems. Outputs may be incorrect, incomplete, outdated, misleading, or otherwise unsuitable. Feynly is an educational aid, not a substitute for professional, academic, medical, legal, financial, or safety-critical advice. We do not guarantee exam outcomes, grades, learning results, or factual accuracy. You remain responsible for reviewing outputs and for how you use them.

7. Acceptable Use

You agree not to, and not to attempt to:

Upload or generate unlawful, infringing, harmful, abusive, exploitative, or deceptive content;
Violate privacy, intellectual-property, or other rights of others;
Interfere with or disrupt the Service, introduce malware, or probe for vulnerabilities without authorization;
Access accounts, systems, or data without authorization;
Circumvent quotas, subscription controls, security measures, or access restrictions;
Scrape, harvest, or make excessive automated requests to the Service;
Reverse engineer the Service except to the extent such restriction is prohibited by applicable law;
Resell, sublicense, or commercially exploit the Service without our prior written permission; or
Upload content you lack the rights to process.

8. Subscriptions, Trials, Billing, and Renewal

Certain features require a paid subscription (“Pro” or similar designation). Prices, billing periods, taxes (where applicable), and any trial or introductory offer are shown before you purchase. Not every user will qualify for every promotion.

Subscriptions are processed by the third-party app marketplace through which the purchase is made. For Android purchases, billing is processed through Google Play. Subscriptions renew automatically unless cancelled in accordance with the marketplace’s procedures before the renewal date. After cancellation, access generally continues through the end of the paid period already purchased, subject to marketplace rules.

Refunds are governed by the applicable marketplace’s policies and by applicable law. You may restore eligible purchases through the restore-purchase flow in the app or marketplace account tools. Failed payments may result in loss of paid access until payment succeeds or the subscription lapses. We may change prices prospectively with notice as required by law or marketplace rules.

Deleting your Feynly account does not by itself cancel a marketplace subscription. Cancel through Google Play (or the marketplace used for the purchase).

9. App License

Subject to these Terms, Feynly grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Android application for your personal, non-commercial use. Additional terms of Google Play or other applicable marketplaces may also apply.

10. Intellectual Property

The Service, including software, design, trademarks, branding, and proprietary content, is owned by Feynly or its licensors. User Content remains subject to Section 5. Third-party content remains owned by its respective owners. No rights are granted except as expressly stated in these Terms.

11. Copyright and Intellectual-Property Complaints

If you believe content on the Service infringes your intellectual-property rights, please send a notice describing the work, the allegedly infringing material, your contact information, and a statement of good-faith belief to support@feynly.app. We may remove or disable access to material and, where appropriate, terminate repeat infringers.

12. Privacy

Our handling of personal information is described in the Privacy Policy. By using the Service, you acknowledge that Policy.

13. Service Availability and Changes

The Service may change, be interrupted, or be discontinued. Maintenance, outages, and errors may occur. We do not guarantee uninterrupted or error-free operation. Material changes to paid features will be handled consistently with applicable law and marketplace requirements.

14. Suspension and Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate access if you violate these Terms, create risk of harm or fraud, if required by law, or if we discontinue the Service. Effects on data are described in the Privacy Policy. Suspension or termination does not waive rights you may have under mandatory consumer law regarding marketplace refunds or cancellations.

15. Third-Party Services

The Service may depend on or link to third-party services, including app marketplaces and processing providers. Those services are governed by their own terms. To the extent permitted by law, Feynly is not responsible for third-party services it does not control.

16. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate or complete, that the Service will be uninterrupted, or that use will produce any particular educational outcome. Some jurisdictions do not allow certain disclaimers; in those jurisdictions, the disclaimers apply only to the extent permitted.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Feynly and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. To the maximum extent permitted by law, Feynly’s total liability for any claim arising out of or relating to the Service is limited to the amounts you paid for the Service in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence where such limitation is void, or for fraud.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Feynly and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your unlawful use of the Service, or your material breach of these Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and, where applicable, the laws of the state in which Feynly principally operates, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your place of residence require otherwise. Subject to those mandatory protections, you agree that courts located in the United States shall have jurisdiction over disputes arising from these Terms. You and Feynly each retain any rights to seek provisional remedies in any court of competent jurisdiction.

20. Changes to the Terms

We may update these Terms from time to time by posting a revised version at this URL. If changes are material, we may provide additional notice through the Service or by other reasonable means. Continued use after the revised Terms take effect constitutes acceptance to the extent permitted by law. Changes are not intended to apply retroactively to disputes that arose before the revision.

21. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any marketplace terms that apply to your purchase, constitute the entire agreement between you and Feynly regarding the Service.
